2025 NPR+ Valentines Giveaway (the "Giveaway")
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.
OPEN TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES, THE DISTRICT OF COLUMBIA, AND THE U.S. VIRGIN ISLANDS AND PUERTO RICO AGE EIGHTEEN (18) OR OVER (OR AT LEAST THE LOCAL AGE OF MAJORITY IN THE JURISDICTION WHETER PARTICIPANT RESIDES, IF HIGHER THAN 18). VOID IN ALL JURISDICTIONS OTHER THAN THOSE STATED ABOVE, AND WHERE PROHIBITED OR RESTRICTED BY LAW.
1. Sponsor:
The Giveaway is sponsored by National Public Radio, Inc., a District of Columbia nonprofit organization with principal offices at 1111 North Capitol Street NE, Washington, DC 20002 ("NPR" or "Sponsor").
2. Eligibility:
The Giveaway is open only to legal residents of the fifty (50) United States, the District of Columbia, the U.S. Virgin Islands, or Puerto Rico who are at least eighteen (18) years of age (or the local age of majority in the jurisdiction where the participant resides, if higher than 18) at the time of entry. Void where prohibited or restricted by law.
Employees, representatives, agents, directors, and officers of NPR and its parent, subsidiary, or affiliated companies (including, without limitation, National Public Media LLC or any NPR member stations) and any other party involved in the marketing or administration of the Giveaway (collectively, the "Giveaway Parties") and each of the immediate family members of such excluded individuals (i.e., spouses, parents, children, siblings and the "steps" of each) and all persons living in the same household of each are not eligible to enter.
By participating in this Giveaway, entrants agree to be bound by these official rules ("Official Rules") and by the decisions of the Sponsor, which shall be final in all matters relating to the Giveaway.
3. Entry:
NO PURCHASE NECESSARY AND NO ENTRY FEE, PAYMENT OR PROOF OF PURCHASE NECESSARY TO ENTER OR WIN. To enter the Giveaway, visit the Giveaway website and complete and submit the official entry form with all requested information. To be eligible, entry forms must be submitted between 12:00 a.m. E.T. on February 9, 2025, and 11:59 p.m. E.T. on February 15th, 2025. Sponsor's clock is the official timekeeping device for the Giveaway. Sponsor is not responsible for late or unsuccessful attempts to enter.
Compliance with the entry requirements will be determined by Sponsor in its sole discretion. Entries that violate, as determined by the Sponsor, in its sole discretion, these entry requirements or do not meet the entry deadlines will be disqualified from the Giveaway.
4. Prize:
One (1) individual who submits the official entry form in accordance with these Official Rules will be randomly selected as the winner from a drawing of all eligible, timely received entries, and will receive a
one-year of the NPR Plus podcast bundle (Approximate Retail Value ("ARV"): $96.00) and an NPR merchandise package (ARV: $100.00) (together, the "Prize"). The total ARV of the Prize is approximately One Hundred Ninety Six Dollars ($196.00). In no event will more than one (1) Prize be awarded. The odds of winning will depend on the number of eligible entries submitted. NPR will attempt to contact the winner via e-mail (to the email address provided in the potential winner's entry) on or about February 18, 2025. No Prize substitution or changes are allowed except at the sole discretion of NPR, and a Prize cannot be substituted or redeemed for cash. All expenses not specified herein, including, without limitation, any applicable federal, state, and local taxes, are the winner's sole responsibility. If a potential winner (i) is determined to be ineligible by Sponsor, (ii) fails to respond to the potential winner notification within forty-eight (48) hours, or (iii) fails to provide any information or documents requested by Sponsor, then the potential winner will be disqualified and forfeits all interest in the Prize and Sponsor may award the applicable Prize to an alternate winner selected by random drawing from among all remaining eligible entries or not award the Prize.
WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS GIVEAWAY, INCLUDING THE PRIZE, IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
As a condition of receiving the Prize, the winner must provide Sponsor with a valid mailing address. Sponsor will pay for the cost of delivering the Prize to winner within the United States. The method of shipping and the carrier will be determined in the sole discretion of Sponsor. Sponsor is not responsible for any Prizes that are lost, stolen, undeliverable, or returned.
The winner's use of the NPR Politics Podcast Plus subscription will be subject to NPR's Terms of Use found at https://www.npr.org/about-npr/179876898/terms-of-use.
5. Privacy:
Any names, addresses, e-mail addresses, or other personal identifiable information submitted or collected in connection with the Giveaway will be treated in accordance with these Official Rules, for the administration and fulfillment of the Giveaway, and as otherwise described in NPR's Privacy Policy.
6. Governing Law:
This Giveaway is governed by the internal laws of the District of Columbia without regard to principles of conflict of laws. All cases and claims pertaining to this Giveaway must be brought in a court of competent jurisdiction in the District of Columbia.
7. General Terms and Conditions:
To the extent permitted by applicable law, the Giveaway Parties assume no liability and are not responsible for, and by entering the Giveaway, you hereby waive and release the Giveaway Parties from, any actions, claims, damages, losses or injuries of any kind (collectively "Claims") arising in connection with the Giveaway and/or the receipt, use or misuse of the Prize, including without limitation, Claims relating to: (i) the malfunction of any computer, telephone, mobile device, network, satellite, hardware, software or communications line; (ii) unauthorized human intervention; (iii) incorrect, delayed or inaccurate transmission, notifications, claims to the Prize or other benefit or other information or communications relating to the Giveaway, or the failure to capture or transmit any such information; (iv) damage to any person's computer or mobile device; or (v) any errors in these Official Rules, notifications or other announcements or communications relating to the Giveaway.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES AND PURSUE ALL OTHER REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
Sponsor may prohibit an entrant from participating in the Giveaway or being offered the Prize if, in their sole discretion, they determine that said entrant is attempting to undermine the legitimate operation of the Giveaway by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or any Giveaway Parties.
If an entrant is a California resident, such entrant hereby waives California Civil Code Section 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
Sponsor reserves the right, in its sole discretion, to terminate, modify, or suspend this Giveaway if it is not practically capable of running as planned due to any of an act of God; unavoidable accident; epidemic; pandemic; fire; blackout; act of public enemy; war, riot or civil commotion; enactment, rule, order or act of government, governmental instrumentality, or tribunal; strike, lockout, or other labor dispute; inclement weather; failure of technical facilities; failure of third-party software or services; or other cause beyond Sponsor's' control that affects the administration, security, fairness, integrity, or proper conduct of the Giveaway. In the event of cancellation, Sponsor reserves the right to select a winner from a random drawing of all non-suspect, eligible entries submitted as of the time of cancellation.
SPONSOR WILL NOT BE OBLIGATED TO AWARD ANY PRIZE THAT RELATES TO OR ARISES OUT OF IMPROPER OR MISTAKEN PRIZE NOTIFICATION, OPERATION, OR FUNCTION OF THIS GIVEAWAY.
SPONSOR RESERVES THE RIGHT TO CHANGE ANY TERM OF THESE OFFICIAL RULES OR TO ADDRESS ANY ISSUE THAT ARISES WITH UPDATES OR AMENDMENTS TO THESE OFFICIAL RULES AT ANY TIME UP TO THE DATE THAT A PRIZE WINNER IS SELECTED.
